There are some voice actors that are able to imitate like a mofo. Yes Sam's a slimeball who steals all art and deserves to have his things stolen and have him put into poverty permanently so he knows what its like to be held down like he's holding down other artists, but the bastard probably just paid another voice artist and will probably get away with it. Luckily it will cost him something though

And it's very likely they had a voice model that was trained on a lot of voice samples (probably including ScarJo's, given OpenAI's draconian gobbling up of every piece of content they can get their hands on) and then fine-tuned by having this VA imitate her.
But that doesn't make it legal. See the successful suits by Bette Midler and Tom Waits for examples of not being able to get away with making people think your knockoff artist is the actual artist. And the evidence of this is compounded by the undisputed facts that a) OpenAI did try to get ScarJo to do the job and b) Altman posted that one line tweet "Her", which is the name of the movie that had the performance that this voice is imitating. From that evidence, it's pretty clear that they wanted their Her-like product to sound like ScarJo performing it.
