[Trump Foundation] NY AG Wins Race To Prosecute President

BogartBogart Streetwise HerculesRegistered User, Moderator Mod Emeritus
From the New York Times.
The New York State attorney general’s office filed a scathingly worded lawsuit on Thursday taking aim at the Donald J. Trump Foundation, accusing the charity and the Trump family of sweeping violations of campaign finance laws, self-dealing and illegal coordination with the presidential campaign.

The immediate response:

Discuss this case and only this case in this thread.

good news: He can't pardon his way out of state charges

Bad News: they aren't seeking even a single day of time for millions of dollars of fraud and tax evasion.

Nope. The state's solicitor general, Barbara Underwood, took over. She doesn't have a huge public profile and wasn't recently disgraced so of course Trump doesn't mention her.

No, he resigned pretty quickly after the allegations against him came out.

Just because this is starting as a civil suit doesn't mean that it can't end with a criminal referral.

    This is amazing

Where’s David Fahrenthold to refute this and get another Pulitzer for it

Speaking of Underwood, she's released a Twitter thread detailing the charges:

Barbara Underwood is the acting Attorney General for the state of New York.

It has an overview of the charges, plus the filing.

I'd just like to point out the absurdity that this is the sitting President of the United States of America, being prosecuted for charity fraud.

    This is not normal.

A settlement would likely include the dissolution of the Trump Foundation and the Trumps being barred from taking part in non-profits in the future.

The con is that rather than pay Trump for a speaking engagement (for example, could be something else) he would suggest he would speak for free if a donation was made to his foundation. This made it so nobody had to pay taxes, and then Trump used the foundation’s money as his own.

The actual values are relatively common. Foundations are required to give out a percentage of their endowment a year, but the rest gets invested, so typically more money will get given out than is put into it.

Exactly the whole thing is a circular tax fraud

people who donated to his foundation got tax credits

the foundation itself is exempt from tons of taxes

Money trump used for his personal reasons wasn't taxed as part of his income.

This is one of the craziest themes of the Trump presidency.

It should have been obvious after essentially nobody (I think 1 actual person) got jail time in the aftermath of 2008, but Trump's election really has put a spotlight on all the shit that happens every day in NYC.

And that jail time isn't even really on the table for any of these charges is another thing I'll be losing sleep over.

1 justice system for rich and poor with punishments commensurate to the crimes... that's all I want for Trump's birthday.

That's an even bigger ball of wax than just normal tax fraud to have campaign officials directing disbursements.

So, I've seen a couple of times about how all of this is just part and parcel of NYC's real estate industry, and the concern that pulling too hard on this thread will unravel that whole system. I realize that excessive damage to an economy is a bad thing, but would it really be that bad to clean this system out?

If there was any justice in the world, these people would spend the rest of their natural lives in prison

Freaking Al Capone went to prison for this shit, why should the Trump family crime syndicate be any different because they hid behind a 501(c) and used it to pretend that the money they were stealing from the rest of Americans was being put to good, charitable use

I’m fucking embarrassed for our country

Barbara Underwood! The President is the corrupt stooge of a foreign government! Are you a bad enough woman to arrest the President and his family?

The downside to Mueller running a tight ship has been that Trump has had the bully pulpit to himself and has won back some of his public support.

Even though the stakes are lower the AG publicly illustrating that the President is still a corrupt shitbird will help keep folks from becoming prejudiced against the findings of other investigations.

Yeah, Avenatti showed us that the right way to oppose the President is boldly and publicly. He's not actually very GOOD at the whole social media bullying thing, its just that noone fights back with a public profile and a consistent message. She needs to get one of his kids in court and find them guilty of something and throw the book at them. Hit them with a catastrophic fine that they can't pay. They are corrupt idiots, they are guilty of something. Who cares if other people do the same thing all the time. Burn those idiots to the ground and DARE them to start the mudslinging, "Everyone does this all the time in the NYC real estate market" and see how well that argument flies.

I don't think there's any way out of this, even with abuse of the powers of the Executive office. That's what makes me happy about this lawsuit.

What also makes me happy is I'm pretty sure that some of the funds abuse for this charity are already matters of public record so a case absolutely exists. There's also arguments to be made about how bad-faith the word of the Trump Foundation and its leaders are, given how many times Trump has declared he's giving money to charity but the check never arrives.

I am surprised it took this long given what the Washington Post reporter found just from what was publicly available.
