    Two stories from Kotaku:
Rein thinks publishers will control DD
During the session Epic VP Rein also warned that digital distribution should not be considered as a way for developers to circumvent publishers. “Digital distribution is not a replacement for a publisher,” he said, noting that it was only a matter of time before publishers begin to dominate the front pages of digital distribution channels.
With Activision and Ubi already on steam, and EA's efforts being laughable, I think that he's way off the mark. Didn't Valve say that they sold more copies of the Orange box (PC obviously) through steam than in retail?

also, Nintendo reconfirms that they aren't deliberately creating a shortage. Kotaku's commenters give me even more of a headache than neogaf, maybe even worse than gamefaqs

You'd think some of these patent cases could be resolved in front of the jury with a simple, "Come on. COME ON"

I'm confused as hell how the N64 controller with rumble pack (which predates that patent) isn't the entirety of their (successful) defense.

The rumble pack probably uses a different method to make it rumble.

What the hell is Anascape anyway? The only articles about it are on how they sued Microsoft and Nintendo.

Live Gamer, the operator of a publisher-supported marketplace for real money trading of virtual items, has announced an agreement with Sony Online Entertainment to offer real money trading in The Agency and Free Realms.

Earlier this year, Live Gamer incorporated SOE's Station Exchange technology - the first publisher-developed and sanctioned RMT marketplace - into its own e-commerce platform. The Live Gamer Exchange is currently operating within EverQuest II.

"We are actively exploring free-to-play and other revenue models, and always looking for new ways to engage and entertain gamers," said SOE president John Smedley.

"Live Gamer is a proven partner that protects and supports our gamers who participate in RMT. We trust them to handle this area of the business for us so that we can focus on creating and growing our games."

Live Gamer co-founder and president, Andrew Schneider, noted that the idea of RMT has been built into The Agency and Free Realms "from the very early stages of design."

Both MMOs will be available for the PS3 and the PC.
Selling imaginary shit is serious business.

In other news, Nintendo lost a federal trial court case over a Patent lawsuit regarding its Wavebird, GCN, and Classic Controllers (but NOT the wii remote/nunchuck, that control interface is not at issue in this case). MS was sued for the same reason and settled out of court; damages were set for Nintendo at $21M dollars, but obviously Nintendo will appeal the decision as is typical of suits of this nature, and Nintendo expects the damages to be reduced "significantly." Without more information on the matter it's hard to give much of an opinion on the legal state of the case.

    here's kotaku's summary:
In 2006, a small Texan company by the name of Anascape Ltd. took Nintendo and Microsoft to court, claiming the pair had infringed on patents Anascape held relating to game controllers (presumably this one, filed in 2000, for a "3D controller with vibration"). While Microsoft decided to settle things out of court, Nintendo stuck to their guns, a move which has now cost them $21 million after a Federal jury ruled in Anascape's favour. The ruling applies to Nintendo's GameCube, Wavebird and Classic controllers (but not the Wii Remote or Nunchuk). Nintendo have said only that they plan to appeal, and that they expect the court to "significantly" reduce the amount of money they have to cough up.

Wait, wait, wait. They filed the patent 3-4 years after the N64 Rumble Pack and Dual Shock's were released and they're suing Microsoft and Nintendo for implementing it? How does this even become an issue?

And I'm also guessing that that's why they didn't sue Sony either? Because they can't do shit about the Dual Shock, since they've just had numbers thrown on the end but they can sue Nintendo because their controllers have actually had different brand names?

Oh and slash, that Guardian blog you quoted, the one that said Sony takes a $260 loss from each PS3? It hurted me brains. Even overlooking some of the obvious things that seem weird in his theory (like where his PS2/PSP $1.2 billion number came from or how he knows that every other SCE product either made a profit or broke even), it still doesn't make much sense. So he's calculated the average amount Sony lost on the PS3 last year, woohoo? It's not like hardware prices are constant, it would've costed a hell of a lot more in Q1 than it did in Q4.

You can file U.S. patents for things you haven't even built. I mean, if you come up with a detailed enough and decent-enough sounding description you could theoretically patent time travel. There's all sorts of shit patented that hasn't even been created, it's just people coming up with ideas, patenting them and hoping someone else gets the same idea and makes money off it.

I'll have to agree that the Guardian's calculations are vaguely interesting but ultimately meaningless.

Anyway, NPD numbers. Mind if I make a new thread an hour or so before?

Has anyone noted this from kotaku?
CBS Corporation just announced an agreement to buy CNET for $1.8 billion dollars. Through the deal, all of CNET's network sites, including GameSpot, TV.com mp3.com, CNET news.com, UrbanBaby, CHOW, Search.com, BNET, MySimon and TechRepublic all become property of CBS.

    [edit]

So what is the minimum difference between Wii and 360 sales needed to make this Pachter prediction true?
Michael Pachter with Wedbush Morgan Securities simply called Microsoft's announcement "spin," adding, "Nintendo will pass them this month."

    From this next-gen.biz article.
