I think the main battle is over the release of the sex tape harming the Hulk Hogan brand. The defense is maintaining that Terry Bollea was fine with the tape and talked about it frequently before its release.
Also several parties regarding the tape have already settled including Bubba the Love Sponge.

The case is pretty interesting in that it is the first indecency/journalism case to make it this far. Not really any precedent before hand re: sex tapes.
