Kong appears to have the necessary bulk to stand up to Godzilla, the agility to dodge his attacks and he has the edge in intellect, as a tool user. (Seen in the trailer where he manages to slap together an axe that can absorb Godzilla's atomic breath)
Also the rights to Kong are easier to get than the rights to Godzilla.
This is Kong's fight to lose.

Nintendo showed the court that Universal had previously successfully argued against RKO that Kong and his story existed in the public domain, and thus were able to get 1.5 million dollars in damages and fees from Universal.

Yep. In fact, the original "King Kong vs Godzilla" movie was originally planned as "King Kong vs Frankenstein" and would have featured King Kong battling a new Frankenstein's Monster made from the parts of various large animals. "Frankenstein" was public domain, so why not?
When the movie was retooled to feature Godzilla instead of a Frankenstein's Monster (don't worry, Toho eventually made a giant Frankenstein's Monster movie AND a sequel called "War of the Gargantuas"), King Kong was--for some reason--given a Frankensteinian affinity to electricity. In the final battle of the movie, Kong is struck by lightning and empowered by it, putting him on more equal footing with Godzilla.
To make things even weirder, Toho later retooled a proposed King Kong movie called "Operation Robinson Crusoe" into the Godzilla movie "Ebirah, Horror of the Deep" (don't worry, Toho would later make a movie where Kong fought a Mechanikong as well as creating a King Kong anime). It appears that the creators of "Ebirah, Horror of the Deep" pretty much just replaced all instances of "King Kong" in the script with Godzilla, resulting in Godzilla not only inheriting the lightning affinity Kong himself had gotten from Frankenstein's Monster, but also in Godzilla showing an unusual amount of interest in a human woman for the only time in the entire franchise.
To top this all off, in some versions of Godzilla movies released in various European countries "Frankenstein" was often inserted into the title, sometimes with the dub explaining that Godzilla's foe for the movie was created by an off-screen Dr. Frankenstein.

Another fun fact: When Toho couldn't get Universal to agree to letting them use King Kong in a new versus movie against Godzilla, they briefly planned a "Godzilla vs Mechanikong" movie instead. Universal got wind of this and told Toho to cut it out.
"Godzilla vs Mechanikong" also included the concept of a Fantastic Voyage into Godzilla's body, so when Mechanikong became a non-option Toho briefly toyed with a pitch called "Micro-Universe In Godzilla" before switching over to "Godzilla vs Mothra: The Battle for Earth", which itself started as "Godzilla vs Gigamoth". The Gigamoth concept became Battra (short for "Battle Mothra").
